Prices & Payments
All prices stated on the website are stated in U.S. dollars and all payments shall be in U.S. dollars.
Orders are placed and received exclusively via the Site. For security purposes, it is not possible to place orders via e-mail, phone or chat.
If you are having trouble with placing an order on our website, please contact us at
help@purescenic.com and we can help with troubleshooting the issue.
We reserve the right to refuse any order you place with us.
After receiving your order, you will receive an email from us confirming the details, description, and price for the products ordered together with some information on your rights to return your goods.
Payment of the total price must be made in full before the dispatch of your products.
All Credit Card transactions will therefore be processed on the same date of the order.
This capture of payment will be more than 1 business day in advance of shipment.
As Pure Scenic’s wall art is made-to-order, wall art prints are shipped between 3-5 business days after capture of payment.
If we do not receive your payment your order will be cancelled, and we will notify you by e-mail.
By accepting delivery of any product sold from Purescenic.com you (“Customer”) agree to be bound by the terms and conditions listed.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
Stripe Payment Gateway
We use the 3rd party service solution, Stripe, and its affiliates to process transactions (including payment transactions) for us.
As a 3rd party service Stripe Payment Gateway ensures the security of the payment solution.
In order to guarantee safe online payment and the safety of your personal data, the transaction data will only be wired while encrypted with SSL (Secure Socket Layer) technology through Stripe.
The experience for you is seamless and you never need to leave the site.

Accepted Credit Cards
With Stripe we can accept MasterCard, Visa, American Express, Discover, JCB, and Diners Club cards.
To buy with Credit Card you must supply the Card number, the date of validity of your card, Card holders name, and your CVV number (card verification value) or CVC (card verification code) on the back of it.
By placing an order, you confirm that you are legally entitled to use the means of payment tendered and, in the case of card payments, that you are the cardholder.
In case of fraudulent use, we cannot be held liable.
Pure Scenic may refuse to process a transaction for any reason or refuse Service to anyone at any time at Pure Scenics’s sole discretion.
Apple Pay
With Stripe it is also possible for us to accept payment via Apple Pay.
Apple Pay makes it easy for you to pay with just a touch on your iPhone, Apple Watch, iPad, or Mac, with your stored credit card information.
Apple Pay gives you a faster payment and because your card details are never shared by Apple, making payments with Apple Pay are a safe, more private way to pay.

Bank statement
When the transaction has been made you will be able to see the transaction in your bank statements.
As the web shop Pure Scenic is run under the company name “US Net Sellers LLC” you should look in your statements for a transaction under this name.
The listing on your bank statement should say:
“US NET SELLERS LLC”
Unfortunately, a bank statement only gives us 18 – 23 characters to describe our business, so there isn’t room for any more information, like the website name or the product name of the product you bought.
The transaction will be made to our Business Checking Account in Bank of America, through the payment gateway, Stripe.

Sales tax
Pure Scenic does not charge you any sales tax.
Our company is based in Delaware where there is no sales tax and as we are a small company with under 100.000$ in sales per year in other states we do not have to charge you sales tax.
You may, however, have to pay “use tax” as a consumer of our products to the state you live in.
Use tax is a sales tax on purchases made outside your state of residence on which no tax was collected, but the purchase would have been taxed if it was bought in your state of residence.
If you buy our product for resale you are responsible for collecting sales tax according to your end customer’s state of residence.
Products and product descriptions
All products available for purchase are described on their specific page on our site.
We are constantly updating product and service offerings on the Site.
We always try to represent each product as accurately as possible via images.
We use our best efforts to provide you with the best images and descriptions but unfortunately cannot guarantee that colors and details in website images are 100% accurate representations of the product.
The colors you see on your monitor may be close to what is printed, but due to differences in the color calibration of monitors, a perfect match cannot be guaranteed.
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
If a product offered by Pure Scenic is not as described, your sole remedy is to return it in unused condition.
We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us.
All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason.

Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communication be in writing. In Purchasing any images on this website, you obtain no copyright rights or other intellectual property rights of any form in the content and may not duplicate or republish the art or photography for any reason, including, but not limited to, commercial purposes.
Copyright infringements

Use License
Pure Scenic’s photographs are protected by copyright as well as any other materials or services on the website.

You further agree that your contributions will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. We take no responsibility and assume no liability for any comments posted by you or any third-party. Indemnification

Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
Liability Limits
To the fullest extent permitted by law, neither Pure Scenic, nor our employees or directors shall be liable to you and your customers for any lost profits or revenues, or for any consequential, incidental, indirect, special, or punitive damages arising out of or in connection with the Services or this agreement.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Pure Scenic, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if Pure Scenic or a Pure Scenic authorized representative has been notified orally or in writing of the possibility of such damage.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Responsibility and limits
Pure Scenic is responsible for safekeeping of Products and damages or losses incurred while the Product is in possession of Pure Scenic or it’s fulfillment partner. However, Pure Scenic is not liable for any losses or damages caused by the carrier or in the event of non-delivery due to incorrect address provided by the User or Customer. Pure Scenic shall under no circumstances be held liable for any special losses due to specific circumstances of the User and/or Customer, indirect or consequential losses or wasted expenditure.
Severability
These Terms of Use operate to the fullest extent permissible by law.
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
Governing Law
By visiting Pure Scenic, you agree that the laws of the state of Delaware, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and Pure Scenic or its associates.
These Terms are subject to the dispute resolution procedure as prescribed by the Agreement.
Disputes
If a dispute arises between you and Pure Scenic, we strongly encourage you to first contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
Informal Negotiations
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Use (each a “Dispute” and collectively, the “Disputes”) brought by either you or us (individually, a “Party” and collectively, the “Parties”), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least 30 days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.
Binding Arbitration
If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute (except those Disputes expressly excluded below) will be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.
The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes (“AAA Consumer Rules”), both of which are available at the AAA website www.adr.org.
Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Consumer Rules and, where appropriate, limited by the AAA Consumer Rules. (If such costs are determined to by the arbitrator to be excessive, we will pay all arbitration fees and expenses.).
The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator will make a decision in writing but need not provide a statement of reasons unless requested by either Party. The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so.
Except where otherwise required by the applicable AAA rules or applicable law, the arbitration will take place in Delaware. Except as otherwise provided herein, the Parties may litigate in court to compel arbitration, stay proceedings pending arbitration, or to confirm, modify, vacate, or enter judgment on the award entered by the arbitrator.
If for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in Delaware, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction, and forum non conveniens with respect to venue and jurisdiction in such state and federal courts. Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Terms of Use.
In no event shall any Dispute brought by either Party related in any way to the Site be commenced more than 1 year after the cause of action arose. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
Restrictions
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
Terms and termination
These Terms of Use shall remain in full force and effect while you use the Site.
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Purescenic.com without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification shall survive any termination.
WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE OR OF ANY APPLICABLE LAW OR REGULATION.
